1. Acceptance of Terms

By accessing the Furious Auto Shipping website (furiousautoshipping.com), submitting a quote request, booking a transport order, contacting us by phone or email, or using any of our services, you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any other policies referenced herein. If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a binding legal agreement between you ("Customer," "you," or "your") and Furious Auto Shipping, LLC ("Company," "we," "our," or "us"). You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Nature of Our Services — Marketing Company Disclosure

Our role in the auto transport process is to:

• Accept your quote request and gather your vehicle transport requirements
• Share your shipment details and contact information with dedicated, licensed auto transport partners in our vetted network
• Allow our partners to contact you directly to provide accurate pricing, availability, and to complete the booking process
• Connect you with companies that maintain active FMCSA authority to legally coordinate or perform your transport

The physical transportation of your vehicle is performed exclusively by independently licensed motor carriers. The contractual relationship for the transport itself is between you and the assigned auto transport partner, as documented on the Bill of Lading (BOL) signed at pickup.

3. Lead Sharing and Partner Network

By submitting a quote request, contact form, or booking a shipment through Furious Auto Shipping, you expressly authorize us to:

• Share your personal information, vehicle details, and route information with licensed motor carriers, co-brokers, and trusted auto transport partners in our network for the purpose of fulfilling your transport request
• Allow our partner network to contact you directly by phone, email, or SMS regarding your quote, booking, or shipment status
• Transfer your shipment request to a partner broker or carrier if doing so results in better pricing, faster pickup, or superior service for your specific route and timeline

All partners within our network are required to hold valid FMCSA broker or carrier authority, maintain adequate insurance coverage, and comply with applicable federal and state regulations. This lead-sharing practice is the core function of our marketing business and is necessary to connect you with companies that can fulfill your transport needs.

By using our services, you acknowledge and consent to this information sharing. If you do not consent, please do not submit a quote request or use our services.

4. Quotes, Pricing, and Booking

4.1 Quotes and Estimates

• All quotes provided by Furious Auto Shipping are estimates only and are not a guarantee of the final price
• Final pricing is confirmed upon carrier assignment and may vary based on route conditions, vehicle specifications, carrier availability, fuel costs, and seasonal demand at the time of dispatch
• Quotes are valid for 7 calendar days from the date issued, unless otherwise stated
• We reserve the right to adjust pricing if the information you provide (vehicle condition, dimensions, operability, or locations) proves inaccurate

4.2 Booking and Payment

• Booking may require a reservation deposit to secure carrier assignment. The deposit amount, if any, will be clearly stated before you confirm
• The remaining balance is due to the Carrier Partner directly at the time of vehicle delivery, unless alternative payment arrangements are agreed in writing
• Accepted payment methods include credit cards, debit cards, certified checks, cashier's checks, and money orders. Specific payment methods accepted by the carrier will be communicated prior to pickup
• All prices are quoted in US Dollars (USD)

5. Customer Responsibilities

5.1 Accurate Information

You are responsible for providing complete, accurate, and truthful information at all times, including vehicle details, pickup/delivery addresses, contact information, and vehicle condition. Inaccurate information may result in pricing adjustments, service delays, or additional fees.

5.2 Vehicle Preparation

Prior to pickup, you must:

• Remove all personal belongings — carrier insurance does not cover personal items
• Ensure fuel level is at or below 1/4 tank
• Disable all aftermarket alarms and anti-theft devices
• Secure or remove loose exterior parts (antennas, spoilers, mirrors, bike racks)
• Document pre-existing damage with dated photographs before the carrier arrives
• Ensure the vehicle is in operable condition, unless an inoperable shipment has been specifically arranged and priced
• Provide one set of keys to the carrier driver at pickup

5.3 Availability

• You or an authorized adult representative (18+) must be present at the agreed pickup and delivery locations
• You must be reachable by phone during the pickup and delivery windows
• If you are unreachable or unavailable during the scheduled pickup window, the carrier may leave without loading the vehicle, and rebooking fees may apply

6. Insurance, Liability, and Damage Claims

6.1 Carrier Insurance

All Carrier Partners in our network are required to maintain:

• Active FMCSA motor carrier authority (MC Number)
• Valid US Department of Transportation (DOT) registration
• Minimum $750,000 in cargo insurance coverage per occurrence
• General liability and auto liability insurance as required by federal law

6.2 Limitation of Liability

Furious Auto Shipping is not liable for:

• Damage to the vehicle during loading, transit, or unloading (carrier liability)
• Delays caused by weather, road conditions, mechanical failures, traffic, or force majeure events
• Loss of, theft of, or damage to personal belongings left inside the vehicle
• Mechanical or electrical failure of the vehicle during transport
• Any indirect, incidental, consequential, special, or punitive damages of any kind
• Acts of God, natural disasters, government actions, or other events beyond reasonable control

In no event shall Furious Auto Shipping's total aggregate liability to you for any and all claims arising out of or relating to our marketing services exceed $100.00.

6.3 Damage Claims Process

• At delivery: Carefully inspect your vehicle and compare it to the condition documented on the Bill of Lading (BOL) at pickup
• If damage is found: Note all damage on the BOL at delivery, take photographs, and do NOT sign the BOL as "clean" or "no damage"
• Notify us: Report damage to Furious Auto Shipping within 24 hours of delivery
• File a claim: Damage claims must be filed with the Carrier Partner's insurance within 9 months of delivery per federal regulations (49 U.S.C. § 14706)
• We will assist you in contacting the carrier and initiating the claims process. However, the claim itself is between you and the Carrier Partner's insurance provider

7. Cancellation and Refund Policy

• Before carrier assignment: Full refund of any deposit paid
• After carrier assignment, before pickup: Subject to carrier cancellation fees, which vary by carrier. Any non-refundable carrier fees will be deducted from your refund
• After pickup (vehicle in transit): No refund. The transport order cannot be cancelled once the vehicle is loaded
• Customer no-show or unavailability: If you fail to make the vehicle available during the agreed pickup window without prior notice, the deposit is non-refundable and rebooking fees may apply
• Force majeure: Refunds for cancellations due to natural disasters, government actions, or other extraordinary events will be evaluated on a case-by-case basis

8. Prohibited Items and Uses

The following items must NOT be placed inside or on the vehicle during transport:

• Firearms, ammunition, weapons, or explosives
• Illegal drugs, narcotics, or controlled substances
• Hazardous materials, flammable liquids, or toxic chemicals
• Perishable goods, live animals, or plants
• Valuables including cash, jewelry, important documents, or electronics

Furious Auto Shipping and its Carrier Partners assume no liability for any prohibited items found in the vehicle. Violation of this policy may result in immediate service termination, forfeiture of deposit, and potential legal action.

9. Indemnification

You agree to indemnify, defend, and hold harmless Furious Auto Shipping, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your breach of these Terms of Service
• Your misuse of our website or services
• Your violation of any applicable law or regulation
• Any inaccurate, misleading, or incomplete information you provide
• Your failure to comply with vehicle preparation requirements
• Any prohibited items found in or on the vehicle during transport

10. Dispute Resolution and Governing Law

10.1 Informal Resolution

Before pursuing formal legal action, you agree to first attempt to resolve any dispute with Furious Auto Shipping informally by contacting us at legal@furiousautoshipping.com. We will make a good-faith effort to resolve your concern within 30 business days.

10.2 Binding Arbitration

If a dispute cannot be resolved informally, you agree that any claim or controversy arising out of or relating to these Terms or our services shall be resolved exclusively through binding arbitration conducted in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association (AAA). Judgment on the arbitration award may be entered in any court of competent jurisdiction.

10.3 Class Action Waiver

You agree that all disputes shall be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding — whether as a named plaintiff, class member, or in any other capacity.

10.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Federal transportation regulations, including those administered by the FMCSA, shall also apply where applicable.

11. Intellectual Property

All content on the Furious Auto Shipping website — including text, graphics, logos, images, icons, software, and design — is the exclusive property of Furious Auto Shipping, LLC or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, or use of any content is strictly prohibited.

12. Warranty Disclaimer

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Furious Auto Shipping regarding your use of our services and supersede all prior or contemporaneous agreements, representations, and understandings.

15. Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
